1. About these terms

These terms apply when you use bramaleatire.com or buy products or services from us, online, by phone or at our shop. By using the site, requesting a quote, reserving, booking or paying, you agree to them. If you don't agree, please don't use the site; you can still call or visit us.

"We", "us" and "Bramalea Tire" mean 940993 Ontario Inc., operating as Bramalea Tire, 2020 Clark Blvd. Unit 6, Brampton, Ontario L6T 5R4. "You" means the person using the site or buying from us, and anyone acting for you.

Nothing in these terms takes away rights you have under Ontario's Consumer Protection Act or other law that can't be waived. If a term conflicts with those rights, the law wins and the rest of these terms still apply.

These terms work together with our Privacy Policy and any written quote, work order or invoice we give you. If a work order or invoice signed or accepted by you says something different about a specific job, the work order or invoice applies to that job.

2. Using our website

Information, not a promise. We work to keep prices, stock counts, fitment, rebate details and service descriptions accurate, but the site can be wrong or out of date. Stock counts are live from our shop and change through the day; a count on the page is not a promise that a tire is available to you.

Errors. If a price, product or detail on the site is wrong, we may correct it at any time, including after you have reserved or requested a quote. If the correct price is higher, we will tell you before any work or payment and you can cancel at no cost. We don't have to honour an obvious error, such as a price far below what the item costs.

Fitment. We match tires and wheels to the year, make, model, trim and tire size you give us, and we check again before anything is ordered or installed. If the vehicle details you give us are wrong, we're not responsible for a product that doesn't fit, and section 7 applies to any return.

Illustrations. Product photos, tread images and vehicle pictures are for illustration. The actual product may look different, for example in wheel finish, sidewall lettering or the date the tire was made.

Third-party links. Links to manufacturers, rebate claim sites, Affirm, Google Maps and others take you to sites we don't control. Their own terms apply there.

3. Assistants, automated tools and acceptable use

You may use an AI assistant or other software to get prices, request a quote, reserve or book on your behalf. Anything it submits for you counts as if you submitted it, and you're responsible for it. The same limits apply as if you did it yourself, including those in section 4.

You must not:

  • use the site to make reservations or bookings you don't intend to keep, or to hold stock to stop others buying it;
  • copy, scrape or harvest prices, stock or content in bulk, or at a rate that slows the site, except through the public pricing pages and in the way they are meant to be read;
  • try to get around booking or reservation limits, for example with several phone numbers;
  • interfere with the site's security, submit false information, or use someone else's details without their permission.

We may refuse, cancel or limit any quote, reservation or booking that breaks these rules, and block access to the site.

Content. The site's text, photos, video, design, logos and software belong to us or the people who licensed them to us. You can view and share pages for personal use. You can't copy or reuse them commercially without our written permission. Tire and wheel brand names and logos belong to their owners.

4. Quotes, reservations, bookings and special orders

Quotes. A quote is our offer for the products and work listed, based on the vehicle details you gave us. Unless it says otherwise, a quote is valid for 7 days and depends on stock being available when you accept it. Requesting a quote doesn't commit you to buy.

Reservations (in-stock items). A reservation holds in-stock tires, wheels or packages for you at the price shown.

  • The hold starts when we confirm it to you by text or email, not when you submit the request.
  • It lasts 24 hours from our confirmation. If you haven't booked the install or come in by then, the items are released and the price may change.
  • You can reserve up to 8 tires at a time, with no more than 2 open reservations per phone number.
  • In-stock reservations need no payment up front. You pay when the work is done, unless we tell you otherwise when we confirm.
  • We may cancel a reservation if the item turns out not to be in stock or fit your vehicle. If you paid anything, we refund it in full.

Bookings. An online booking requests a service time. It's confirmed only once you follow the link we text you and we confirm it. Unconfirmed requests are released.

  • Times are estimates. Work can take longer, especially in peak season or if we find something on the vehicle (section 6).
  • If you're more than 15 minutes late, we may release your bay and serve you as the next one opens.
  • Walk-ins are served as bays open; booked customers may go ahead of you.
  • We may need to move a booking because of staff, equipment, supply or weather. We'll contact you and offer the next available time.
  • To cancel or change, call (905) 793-1881 or use the link in your confirmation. There's no charge to cancel a booking.

Special orders. Items we don't have in stock are ordered from our suppliers for you. These are requests, not bookings: we text you a booking link once the items arrive.

  • We ask for a deposit of at least 25% of the quoted price before we order.
  • Supplier delivery dates are estimates and not guaranteed.
  • If the supplier can't deliver, we tell you and refund your deposit in full, or offer you a substitute you can accept or decline.
  • Once we've placed the order with the supplier, the deposit is non-refundable if you cancel, except where the law says otherwise. We may apply it to restocking and freight costs and refund any balance.
  • If you don't book or collect within 30 days of our arrival notice, we may cancel the order and section 7's special-order rules apply.

5. Prices, payment, financing and rebates

Prices. All prices are in Canadian dollars. Each listing says what it includes. Prices marked "all-in" or "installed" include the items, installation, the Ontario tire recycling fee (OTSF) and HST as described on that page. Other prices are before HST, and may be before installation and the recycling fee where the page says so. Service prices marked "from" are starting prices; larger, run-flat, light-truck and specialty tires cost more, as listed on each service page.

Payment. Payment is due in full when the work is done or when you collect the goods, before the vehicle or goods leave the shop. We accept the payment methods shown at the counter. We keep the right to hold your vehicle or goods until the invoice is paid, as Ontario law allows (section 10).

Financing. Financing is provided by Affirm Canada Holdings Ltd. ("Affirm"), not by us. Approval, rates, terms and payments are set by Affirm and are subject to its eligibility check and agreement. Payment examples on our site are estimates, not offers. Your loan agreement is with Affirm, and questions about payments go to Affirm. If you're not approved, your quote stays valid under section 4 for other payment methods.

Manufacturer rebates. Rebates on our site are run and paid by the tire manufacturers, not by Bramalea Tire.

  • The manufacturer sets the amounts, eligible products, dates, claim rules and approval, and can change or end an offer without notice.
  • You submit your claim to the manufacturer, using the claim link for your rebate on our Rebates page. We'll give you the invoice you need to claim.
  • Rebates are not deducted from our price and are not our obligation. We aren't responsible if a claim is rejected, late, or paid differently from what our page shows.

Our own promotions. Sales, "blowout" deals and package offers run while stock lasts, or until the date shown. Unless a promotion says otherwise, it can't be combined with other offers or applied to past purchases, and items sold as final sale can't be returned (section 7).

6. Service work on your vehicle

Estimates and approval. Before we start, we tell you the price or give you an estimate. We won't charge more than the estimate allows under Ontario law without your approval. If we find something that needs extra work or parts, we stop and ask you first; nothing extra is done without your OK.

Our right to refuse. We follow tire-industry and manufacturer safety rules. We may decline to repair, install or return to service any tire, wheel or part we believe is unsafe or unsuitable for your vehicle, including:

  • punctures outside the repairable tread area, larger than about 6 mm, or in tires driven flat or underinflated;
  • tires with cuts to the cords, bulges, age cracking or bead damage;
  • tires or wheels of the wrong size, load rating, speed rating or type for the vehicle;
  • run-flat repairs the tire maker doesn't allow.

If we decline, we show you why. Inspection charges apply as listed on our service pages.

Condition of your vehicle and parts. Older, corroded or previously damaged parts can fail during normal, careful work. We'll tell you what we see, but we're not responsible for the failure of a part that was already worn, seized, corroded or damaged, including:

  • seized, rusted, cross-threaded or stretched wheel studs, bolts and lug nuts;
  • wheel locks without the key, or with a worn key — please bring your key;
  • TPMS sensors, valve stems and valve cores that are corroded, brittle or at end of battery life;
  • wheels with existing curb rash, cracks, bends, corrosion or flaking paint or coatings.

Replacing a part that fails this way is charged at our listed price, with your approval. This doesn't limit our responsibility for damage we cause through our own negligence.

Customer-supplied tires and parts. We install tires and parts bought elsewhere if they're suitable for your vehicle. We only warrant our workmanship on them, not the products themselves. We may refuse used tires or parts that fail our inspection.

Retorque at about 100 km. Wheels we install are torqued to your vehicle's specification. Wheel nuts can still loosen from heat, temperature changes, impacts or worn hardware. Please return after about 100 km for a free retorque. If you notice a vibration, noise or pulling, stop driving when it's safe and contact us right away. We're not responsible for loss caused by loosened wheels if you didn't come back for the retorque or kept driving after noticing a problem, except where it was caused by our negligence.

TPMS. On vehicles with direct TPMS, the warning light will stay on if a set of wheels has no working sensors. If you choose not to add sensors, that's your decision and the light is not a defect in our work. Sensor programming, relearns and replacements are charged as listed, with your approval.

Road tests and old tires. We may drive your vehicle on public roads to check our work. Old tires are recycled through Ontario's program unless you tell us before the work starts that you want to keep them.

7. Returns and cancellations

Mounted and balanced items are final sale. Once a tire has been mounted and balanced on a wheel, or a tire or wheel has been installed or driven on, it is final sale and can't be returned or exchanged. Warranty problems are handled under section 8.

Unused in-stock items. You can return unused, unmounted tires and wheels within 30 days of purchase, with your invoice, in the same condition you got them. We refund to the original payment method, less any installation or services already performed.

Special orders. Special-order items can be returned only if we agree and the supplier accepts them back. A restocking fee of 25% of the item price, plus any return freight, applies.

Final sale. Items marked final sale, clearance or blowout can't be returned or exchanged, except for a manufacturing defect covered by warranty.

Services. Services already performed can't be refunded, but if our workmanship is at fault, section 8 applies.

8. Warranties

Our workmanship. We stand behind our work. If something we did wasn't done properly, tell us and we will inspect it and correct it at no charge. Our workmanship warranty lasts at least as long as Ontario law requires for vehicle repairs (90 days or 5,000 km, whichever comes first). Bring the vehicle back to us so we can inspect it before anyone else works on it, unless it's an emergency.

Product warranties. Tires, wheels, TPMS sensors and other products carry their manufacturer's warranty, which may be pro-rated by tread wear and limited by age. We'll help you make a warranty claim, but the manufacturer decides it. Road-hazard protection is not included unless it's listed on your invoice.

What warranties don't cover. Normal wear; damage from potholes, curbs, debris or collisions; driving underinflated, overloaded or on a flat; improper inflation; wheel alignment, suspension or other vehicle problems; racing, off-road use or misuse; snow chains or studs not approved for the tire; repairs or changes by someone else; and cosmetic marks such as curb rash or salt corrosion.

Your other rights. These warranties are in addition to, not instead of, any warranties and conditions that Ontario law gives you and that can't be excluded.

9. Tire storage

What you get. Storage is for one set of up to four tires, with or without wheels, for one season of up to 6 months, at the price on our storage page. The storage fee is paid when you drop the set off. We store sets indoors, labelled, on racks, and take reasonable care of them.

What we record. When your set comes in, we record its size, whether it's on wheels, and its tread depth and visible condition. If a set is close to worn out, we show you before it goes into storage and you decide whether to store it. Only items listed on your storage record are stored — caps, centre caps, lug nuts and wheel-lock keys aren't, unless they're listed.

Keep your contact details current. We contact you by the phone number, text or email on your storage record. If they change, tell us. Notices sent to the details on your record count as given.

End of season. Your storage ends when we put the set back on your vehicle, or when you collect it.

  • You must book your swap or collect the set within 30 days after the end of your season.
  • If you don't, the set rolls into a new season and the storage fee for that season becomes due.
  • If any storage fee is unpaid for 90 days, we'll send a written notice to the contact details on your record. If you don't pay and collect, or make arrangements with us, within the time the notice gives, we may sell or dispose of the set as permitted by Ontario's Repair and Storage Liens Act, and apply any proceeds to what you owe.
  • A set that is still unpaid or uncollected 180 days after its storage fee was due is treated as abandoned. We may then recycle or dispose of it, and we are no longer responsible for it.

Release. We release a stored set only to the person on the storage record, or someone they authorise, after confirming the name and phone number on the record.

Natural ageing. Rubber ages over time even when stored well. We're not responsible for normal ageing, cracking, flat-spotting, wheel corrosion or TPMS battery drain that happens during storage.

Our responsibility. If a stored set is lost or damaged because we failed to take reasonable care of it, we'll pay the set's actual cash value — its value at drop-off, allowing for tread wear and age — or replace it with a comparable set, at our choice. We're not responsible for loss from causes beyond our reasonable control. We recommend checking whether your home or auto insurance covers items stored away from home.

10. Vehicles and property in our care

Valuables. Please remove valuables from your vehicle before leaving it with us. We're not responsible for cash, electronics or other personal items left in the vehicle, except where loss is caused by our negligence.

Collecting your vehicle. Please collect your vehicle the same day we tell you it's ready. Vehicles left after closing are parked in our lot at your risk, except for our negligence. From the second business day after we tell you it's ready, we may charge $25 per day for storing it.

Our lien. Under Ontario's Repair and Storage Liens Act, we may keep your vehicle, tires, wheels or other goods until what you owe for our work, parts or storage is paid. If it isn't paid, we may enforce that lien as the Act allows, including by selling the goods after giving the notice it requires.

11. Limits on our liability

To the extent the law allows:

  • we're not liable for indirect or consequential loss, such as lost time, lost income or missed appointments, arising from the site, a delay, or a product or service;
  • our total liability for any product or service is limited to the amount you paid us for it;
  • we don't promise the site will always be available or free of errors, and we're not liable for loss caused by it being unavailable.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.

12. Communications and privacy

When you request a quote, reserve or book, we contact you by text, phone or email about that request: confirmations, booking links, "your vehicle is ready", stock arrival and storage notices. We send promotional messages only if you've agreed to receive them, and you can unsubscribe at any time by replying STOP or using the unsubscribe link. Message and data rates may apply.

How we collect, use and protect your personal information, including information collected through the site, is explained in our Privacy Policy.

13. Disputes, governing law, changes and contact

Talk to us first. If something isn't right, contact us and give us a chance to fix it. Most problems are solved at the counter.

Law and courts. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario, including Small Claims Court in Brampton.

Changes. We may update these terms. The version posted on this page, with its "last updated" date, applies from the time it's posted. Changes don't affect purchases or bookings already made.

If part doesn't apply. If a court finds any part of these terms unenforceable, the rest still applies.
